(hereinafter referred to as “MIRABÉL HOME”)

These General Terms and Conditions regulate the business relationship between MIRABÉL HOME (seller) and its customers (buyers). Customers within the meaning of these terms are both consumers and entrepreneurs.

1. Validity of the General Terms and Conditions

1.1. These Terms & Conditions apply to all deliveries of goods and services from MIRABÉL HOME. They become part of every contract concluded between the customer and MIRABÉL HOME. Any differing purchasing terms of the customer shall not apply unless expressly agreed to in writing.

1.2. Any deviations from these Terms & Conditions require written agreement.

2. Purchase of Goods, Contract Conclusion & Withdrawal

2.1. A binding contract is concluded once the customer receives an order confirmation or when both parties mutually declare their intent to conclude a contract.

2.2. Cancellation of an order is generally not possible. If the customer terminates the contract unilaterally, MIRABÉL HOME is entitled to charge a cancellation fee amounting to 30% of the purchase price.

2.3. For products with a delivery period, a minimum deposit of 30% of the purchase price must be paid.

2.4. If the deposit is not paid within 14 days, MIRABÉL HOME reserves the right to withdraw from the contract and charge the cancellation fee of 30%.

2.5. MIRABÉL HOME may also withdraw from the contract if:

  • the customer delays acceptance of the goods,

  • the customer's financial situation deteriorates significantly,

  • delivery becomes impossible for reasons beyond MIRABÉL HOME's control.

2.6. In the event of withdrawal, both parties shall return any services already received.

3. Delivery Conditions & Place of Performance

Goods may either be collected from MIRABÉL HOME or delivered to the customer's specified address.

Customers must collect goods within 14 days after being notified that they are ready for collection.

Delivery costs are not included in the purchase price unless expressly agreed otherwise.

Standard delivery is curbside delivery. If a disposal service has been booked, old furniture must be placed at the curb before delivery.

4. Delivery Times

Delivery times correspond to the information provided in the product description.

The delivery period begins after:

  • receipt of the required deposit,

  • confirmation of all product specifications.

Delivery times may be extended if:

  • product specifications are changed after ordering,

  • external circumstances beyond the control of MIRABÉL HOME occur,

  • the customer fails to fulfil contractual obligations.

If delivery has still not occurred after an additional grace period of 6 weeks, the customer may withdraw from the contract.

5. Delay in Acceptance

If goods are not collected within 14 days, storage charges of €10 per day may apply.

If delivery cannot be completed due to reasons attributable to the customer, storage costs and additional delivery charges will be invoiced.

6. Costs & Fees

Unless otherwise agreed, all costs listed in the quotation or order confirmation shall be borne by the customer.

7. Prices, Payment & Vouchers

All prices are stated in EUR or CHF, including applicable VAT where required.

A 30% deposit must be paid within 14 days after order confirmation.

The remaining balance becomes due upon collection or delivery.

Deliveries against invoice are generally not available.

Payment obligations remain valid even if delivery is delayed for reasons beyond the control of MIRABÉL HOME.

If there is reasonable concern regarding payment, MIRABÉL HOME may withhold delivery until full payment has been received.

Counterclaims against MIRABÉL HOME may not be offset unless legally mandatory.

Gift vouchers:

  • are personal,

  • non-transferable,

  • cannot be redeemed for cash,

  • cannot be combined with other promotions unless explicitly stated.

8. Retention of Title

All goods remain the property of MIRABÉL HOME until the purchase price has been paid in full.

9. Transfer of Risk

The risk passes to the customer once the goods are dispatched.

For individually manufactured or unique products, the risk transfers upon conclusion of the purchase contract.

10. Product Characteristics

Products correspond to the respective product descriptions.

Minor deviations in colour, texture, dimensions or manufacturing tolerances are customary and do not constitute defects.

Where applicable, screws and mounting accessories are included.

Customers are responsible for ensuring that products can be transported into their premises.

11. Inspection & Complaints

Customers must inspect delivered goods within 5 days after receipt.

Complaints must be submitted within 10 days together with photographs or appropriate documentation.

After this period, the goods shall be deemed accepted unless mandatory statutory provisions provide otherwise.

12. Warranty

The original product packaging should be retained whenever possible.

The warranty period is 24 months.

The warranty does not cover:

  • cosmetic wear,

  • minor deviations,

  • damage caused by improper use.

The warranty becomes void if:

  • the product has been modified,

  • incorrectly assembled,

  • repaired using third-party components.

MIRABÉL HOME reserves the right to determine whether a product will be:

  • repaired,

  • replaced,

  • or receive an appropriate price reduction.

Repair shall generally be the preferred remedy.

Replacement deliveries will be made to the original delivery address.

If replacement parts are unavailable, the regular production lead time (minimum 10 weeks) shall apply.

Showroom and display models are sold "as seen" and are excluded from warranty unless mandatory law provides otherwise.

13. Limitation of Liability

To the extent permitted by law, MIRABÉL HOME shall not be liable for indirect damages, consequential losses or delays beyond its reasonable control.

14. Copyright

All texts, photographs, graphics, product images, logos and website content are the intellectual property of MIRABÉL HOME.

Any reproduction or use without prior written permission is prohibited.

15. Data Protection

MIRABÉL HOME processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

Personal data will not be disclosed without a valid legal basis.

16. Applicable Law & Jurisdiction

These Terms & Conditions are governed exclusively by the substantive laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is Zürich, Switzerland.

17. Severability Clause

Should any provision of these Terms & Conditions become invalid or unenforceable, the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a legally permissible provision that most closely reflects its original economic intent.
